1. Overview
This website is operated by Envious Customz (ABN 75 849 765 659), Brisbane, Queensland, Australia. Throughout the site, “we”, “us” and “our” mean Envious Customz. We sell products under the brands CANDYSCENT™, Ward & Wander and Perfék®, and we offer this website, and all information, tools and services on it, to you on the basis that you accept these Terms of Service (“Terms”).
By visiting our site or buying from us, you agree to be bound by these Terms, including our Privacy Policy, Refund Policy, Shipping Policy and Subscription Policy. If you don’t agree, please don’t use the site.
We may update these Terms at any time by posting changes on this page. Your continued use of the site means you accept the changes. Our store is hosted on Shopify, which provides the e-commerce platform we use to sell to you.
2. Online store terms
You must be at least 18 years old to buy from us, or have the consent of a parent or guardian. You must not use our products or site for any unlawful purpose, or transmit any viruses or destructive code. A breach of these Terms may result in immediate termination of your access to our services.
3. General conditions
We reserve the right to refuse service to anyone, for any reason, at any time. You agree not to reproduce, copy, sell, resell or exploit any part of the site or our services without our written permission. Headings are for convenience only and don’t affect the meaning of these Terms.
4. Accuracy of information
We try to keep information on the site accurate, but we don’t guarantee it is complete or current, and it shouldn’t be your only basis for a decision. We may change site content at any time and aren’t obliged to update it. Occasionally there may be errors in product descriptions, pricing, promotions, shipping costs or availability. We may correct these and cancel or refund an order affected by an error, including where stock levels are wrong and the item isn’t available.
5. Products
All brands. We make every effort to show colours and images accurately, but we can’t guarantee that your screen shows them exactly. Our products are handmade or made in small batches, so scents, colours and finishes can vary slightly between batches. We may limit quantities, products or regions we sell to, and may discontinue any product at any time.
CANDYSCENT™. You’re responsible for the scents and products you choose. Scent descriptions are on our site.
Ward & Wander. Each piece is handmade. Natural variation in stones, beads, metal and finish is part of the piece and isn’t a fault. One-of-a-kind (OOAK) pieces are unique and can’t be remade. Custom and made-to-order pieces are made specifically for you.
Perfék® skincare. Perfék® products are cosmetics. They aren’t medicines and aren’t intended to diagnose, treat, cure or prevent any condition. Results vary between people. Full ingredient lists are provided on the product and on our website, and it’s your responsibility to check them against any allergies or sensitivities. We recommend a patch test before first use. If irritation occurs, stop using the product. Perfék® is currently sold in Australia only.
6. Orders, billing and discount codes
We may refuse or cancel any order, and may limit quantities per person, household or order. This can include orders using the same account, payment method or address, and orders we believe are placed by dealers, resellers or distributors. If we change or cancel an order, we’ll try to contact you using the details you gave us.
You agree to give current, complete and accurate information for all purchases. We aren’t responsible for incorrect addresses entered at checkout. If your order has already been dispatched, you’ll need to contact Australia Post.
Only one discount code may be used per order. Codes don’t apply to all items; where an item isn’t discountable, the product listing says so. Codes must be entered at checkout. We can’t amend orders after purchase and aren’t liable to refund a discount that wasn’t entered at checkout.

8. Your rights under Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You’re entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You’re also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure doesn’t amount to a major failure.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
9. Intellectual property
All content on this site belongs to Envious Customz or is used with permission. This includes our brand names, logos, designs, photographs, product descriptions, written content and website design. Perfék® is a registered trademark. CANDYSCENT™ and Ward & Wander are our brands.
You may not copy, reproduce, modify, distribute or use our content or trademarks without our written permission. If you share photos of our products on social media, you may tag us and we may re-share them with credit.
10. Optional tools and third-party links
We may give you access to third-party tools, and our site may link to third-party websites. We don’t monitor or control them. They’re provided as is and as available, and you use them at your own risk. Please read the relevant third party’s terms and policies before using them. Complaints about third-party products or services should go to the third party.
11. User comments and submissions
If you send us comments, reviews, feedback, ideas or other submissions, you agree that we may edit, copy, publish and use them in any medium, without any obligation to keep them confidential or pay you. You must not submit anything unlawful, abusive, defamatory, obscene or misleading, or anything that infringes someone else’s rights. You must not use a false email address or pretend to be someone else. You’re responsible for what you submit. We may remove content at our discretion.
12. Personal information
Your personal information is handled under our Privacy Policy.
13. Prohibited uses
You must not use the site or its content: for any unlawful purpose; to encourage others to break the law; to infringe our or anyone’s intellectual property rights; to harass, abuse, insult, harm, defame or discriminate against any person; to submit false or misleading information; to upload viruses or malicious code; to collect or track the personal information of others; to spam, phish, scrape or crawl; for any obscene or immoral purpose; or to interfere with or bypass the security features of the site. We may end your access if you breach this section.
14. Disclaimer and limit of liability
Subject to section 8, we don’t guarantee that the site will be uninterrupted, timely, secure or error-free, or that results from using it will be accurate or reliable. We may remove or change the site or services at any time.
To the maximum extent permitted by law, and subject to section 8, we aren’t liable for any indirect or consequential loss, loss of profit, revenue, data or savings, arising from your use of the site or our products. Where the law allows us to limit our liability for a breach of a consumer guarantee, our liability is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.
15. Indemnity
To the extent permitted by law, you agree to indemnify Envious Customz and our officers, employees, contractors and suppliers against any claim or demand made by a third party because you breached these Terms or any law, or violated someone else’s rights.
16. Severability and entire agreement
If any part of these Terms is found to be unlawful or unenforceable, it’s removed to the extent necessary and the rest stays in force. Our failure to enforce any part of these Terms isn’t a waiver of it. These Terms, with the policies referred to in them, are the entire agreement between you and us.
17. Termination
These Terms apply until ended by you or by us. You can end them by telling us you no longer wish to use our services. We may end them if we believe you’ve breached them. Obligations and liabilities that arose before termination continue.
18. Governing law
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland.
